Terms Of Use
1. General
1.1. These Terms Of Use govern access by an end user (“You”) to the Market Databases services and deliverables provided by CACI Limited (“CACI”) via the Liferay portal (“Portal”). Said access is subject to Your compliance at all times with these Terms of Use.
1.2. You may only access the Portal using Your personal user ID and password, during such time as you are an employee or consultant of the bank or building society (and where applicable its subsidiary brands) to whom CACI provides the Market Databases services and deliverables (the “Institution”). If You cease to be employed or engaged to work for that Institution, You will no longer be authorised to access the Portal and You shall immediately cease to access or attempt to access it.
1.3. You shall only upload data related to the Market Databases services (eg. as detailed in the applicable CACI input data specifications) to the Portal. You shall not upload any data, information or materials which infringe any applicable laws, regulations or third party rights, or which are obscene, indecent, pornographic, defamatory, liable to incite racial hatred or acts of terrorism, or which are in breach of any third party intellectual property rights.
1.4. You shall not introduce any software program (including without limitation viruses, worms, spyware and/or Trojan horses) to the Portal which is designed to destroy, damage or disable, or gain unauthorized access to, any computer system, software or electronic data.
1.5. CACI may in its sole discretion provide support to You from time to time as regards Your access to and/or use of the Portal and the Tableau Server Software.
1.6. CACI does not give any warranties in relation to the Portal, its availability or the open source software on which it is built. To the extent permitted by law, CACI shall in no event be liable to You for any loss or damage whatsoever (whether direct or indirect) arising out of Your access to the Portal or the Tableau Server Software.
1.7. English law applies and in the event of a dispute You and CACI agree to submit to the exclusive jurisdiction of the English courts.
2. Copyright
2.1. Some of the CACI deliverables that You access through the Portal contain third party data which is protected by copyright. By accessing the Portal and using said deliverables, You agree to comply with the applicable third party copyright notices contained on the following webpage https://www.caci.co.uk/copyrightnotices.pdf. Said webpage and third party copyright notices are subject to change from time to time as required by the third party data providers. If permitted in Your Master Databases services agreement with CACI, in the event that you copy, export, download or otherwise re-use said CACI deliverables, You must include the above third party copyright notices in any resulting copy or output.
3. Tableau Server Software
3.1. You may access the Tableau Server Software solely via the Portal and solely for the purposes of interacting with visualizations generated by CACI, creating Your own visualizations and/or exporting Your data onto other software applications, in each case solely where related to the Market Databases services. You may not access the Tableau Server Software for any other purpose.
3.2. You shall not (i) decompile, disassemble or otherwise reverse engineer the Tableau Server Software or attempt to reconstruct or discover its source code (except to the extent that applicable law prohibits or restricts reverse engineering restrictions); (ii) distribute, sell, sublicense, rent, lease or use the Tableau Server Software; (iii) remove any product identification, proprietary, copyright or other notices; (iv) modify the Tableau Server Software or create any derivative works thereof or incorporate it into other software; or (v) use the Tableau Server Software to develop a product that is competitive with any Tableau product offerings.
3.3. You acknowledge and agree that Tableau shall have no warranty, support or other obligation or liability to You.
3.4. You shall defend, indemnify and hold CACI harmless from and against all claims arising out of a breach by You of this clause 3 including any damages and costs awarded against CACI or agreed in settlement (including reasonable attorneys’ fees) resulting from such claims. You may not settle any such claim relating to the Tableau Server Software without CACI’s prior written consent.
